ADOPTS

By purchasing an adoptable character design from me (also referred to as an adopt) you certify that you understand and agree to my terms of service listed below:

All Buyers Over 18

• You must be over 18 years of age to purchase adopts from me. My galleries are already 18+ / NSFW spaces, so my character designs are assumed to be intended for adult art use regardless of actual application.
• Therefore by purchasing an adopt from me, you certify you are over 18 years of age.

Business Use vs. Personal Use

• Any character designed by me and any art of them you receive of them in the future is for personal use only, and may not be used for commercial purposes without my express permission, including but not limited to:
  • business branding
  • merchandise or media (games, comics, etc) that will be sold in any physical or digital storefront
  • content kept behind any paywall or paid service (such as Patreon, OnlyFans, Fansly, etc), or advertisement for content behind a paywall.
  Feel free to email me for a quote for a licensing contract and/or business use fee. Any violation of my business use policy may result in me posting a warning to other artists or pursuing legal action if the amount of money made using my design work merits it, so please contact me if you're unsure.

Where You Can Post the Adopt Ref

• Just like with my commissions, you can post the adopt reference art anywhere you like!
• I'd appreciate if you put a link back to me in the post description when you do post the ref to a gallery site (like FurAffinity), or tag me when posting the ref to social media to introduce the character (like on Bluesky). No tagging / crediting beyond that is necessary, like dropping the ref in a thread when an artist asks for characters for warmups for example, since I have my watermark on the ref sheet.
• The only stipulation is if you post the adopt ref, or any alternate versions of the ref, behind a paywall or where it requires payment to see (like on Patreon for example) - if my art or designs are posted to a normally pay-to-access site, no portion of my art or character designs may be used as advertisement to promote new paid memberships without my approval, as this would fall under business use and I would expect compensation.

Edits You Can Make To My Adopts / Refs

• Generally speaking, you can change details about the character in new artwork you get from other artists, but I must remain credited as the original designer.
• I would prefer that my ref sheets not to be edited by anyone other than me.
• If you want to make changes to the ref sheet, I can do it for a small fee using the original project files for best results, or you could commission another artist to make a new ref sheet (though I must remain credited as the original designer of the character, either on the reference art with text in a corner, or in the text description when it gets posted). If changes are made to my ref sheet, please place the name / info of the artist who made the edits next to my watermark logo to clarify who drew what.
• You're free to change name, gender & pronouns, or other non-visual details of the character after buying them. If I've added a name or pronouns in text on the ref sheet, I'll generally do edits to the text on the ref sheet free of charge, so feel free to contact me if you want that info changed later on. You may also change the text on the ref (name, gender, pronouns, or other info) yourself if you're comfortable doing so. I just ask that either I do any changes to the art itself, or you get a new ref sheet from another artist.

Things You May NOT Do With My Adopts / Refs

• You may not claim the adoptable character design as made by you. I understand you may not always be able to link back to me, that's why I put my watermark with my Patreon on there.
• My watermark may not be deliberately cropped out or removed.
• I don't have any restrictions on kink or fetish content my adopts are used in, but if they're used in anything that falls into my unacceptable content list I'll blacklist the buyer from getting future adopts from me.
• Edits or descriptions with my adopts must not use any transphobic / homophobic / otherwise hateful language in their descriptions, such as those listed on this page. If I find out a buyer later uses unacceptable language with my adopts, I may blacklist that buyer.
• Absolutely no cryptocurrency or NFTs. I have a zero tolerance policy regarding any affiliation of my name or my art with "non-fungible tokens" or NFT's, cryptocurrency, or any blockchain-affiliated transaction of any kind, and will blacklist any potential or past buyers who engage with them in any way. Environmental destruction and scams both fall outside of either my legitimate personal or business use policies.
• Absolutely none of my art may be affiliated with AI. I also have a zero tolerance policy regarding any affiliation of my name or my art with large langauge models (LLM's) or generative AI of any kind, and will blacklist any potential or past buyers who engage with them in any way. Deliberately feeding any of my artwork to any learning models, whether an adoptable design purchased from me or any of my other art, and regardless of intent, will also result in immediate blacklisting and a public warning to the community. I do not consent to my art being plagiarized or used to assist the art-devaluing machine. Because of this, I would also ask that my art not be posted to X (formerly Twitter) or deviantArt, as they feed everything to their learning models.

Rights I Reserve

• I reserve the right to post the adopt art to my galleries.
  • Just like with my commissions, I reserve the right to display the original adopt reference and any accompanying concept sketches in my own gallery / portfolio, to use the art in promotional posts, and to include the ref in my digital artpacks.
  • Whenever possible, I'll also link to the buyer's social media presence (unless they requested to remain anonymous on the form). If you decide later you want to be anonymous when I post the ref, let me know and I'll remove your name from files. I can't guarantee that I'll have access to previous uploads that may contain names in files, but I'll do my best to anonymize anything I have immediate access to and prevent future name usage.
  • I'll also clearly separate character designs who have been purchased from other unpurchased adopts to prevent the impression they're still for sale.
• I reserve the right to base new adopts on past sold adopts.
  • I reserve the right to use a previous adopt I designed as a base to design another one-time adoptable, using elements such as pose, anatomy, or revisiting similar themes with the same species. (I would only be comfortable creating another adopt based on a previous one if it had significant changes to be an unmistakeably unique character, I'll never resell a character design I've already sold.)
  • I may also use the pose, anatomy, or outfit details from a past adopt to create a digital "base" that can be sold with interchangeable details for buyers to create their own characters. If I do, these options will never include all the same details as any one adopt I've already sold, so it won't be possible to recreate a past adoptable design of mine.
• I reserve the right to use any of my notes or prompts provided with my adopts for myself in the future.
  • I may choose to revisit story prompts or character background details that I wrote in my Notes.txt files included in purchased adopt folders in my own writing, or for future adoptable ideas.
  • If you do end up using any of the ideas in my provided notes, please let me know! I'd love to see them, and I'll also make a note for myself to avoid using anything too similar to what you've done in my own future writing. It may still overlap partially with my original notes, but I'll make sure it's different from what you end up using.
